These Terms govern your use of nevamiss.ai (the "Site"), operated by Loaderz LLC doing business as Nevamiss ("Nevamiss", "we", "us"). Services for clients are provided under a separate written agreement, which controls if it conflicts with these Terms. By using the Site you agree to these Terms.
Use of the Site
You may use the Site for lawful purposes only. You agree not to interfere with its operation, attempt unauthorized access, scrape it at a disruptive rate, or submit false or unlawful information.
Acceptable use of our services
Our AI agents may not be used for unlawful robocalls or texts, calls or messages without the consent the law requires, deceptive practices, harassment, or any activity that violates the TCPA, CAN-SPAM, CASL, carrier rules or other applicable law. We may suspend services that are used this way.
Information on the Site
Content on the Site, including information about laws such as the TCPA, A2P 10DLC, CASL, HIPAA or fair housing rules, is general information and not legal advice. Example conversations use fictional businesses and are illustrative only.
AI agents
AI systems can make mistakes. Clients are responsible for approving the information, prices and policies their agents communicate and for complying with the laws that apply to their business, and should review agent output regularly.
Intellectual property
The Nevamiss name, logo and Site content belong to us or our licensors. Other product and company names are trademarks of their respective owners and are used for identification only; no affiliation or endorsement is implied.
Third-party links
The Site may link to third-party websites we do not control. We are not responsible for their content or practices.
Disclaimer of warranties
The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Nevamiss will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, arising from your use of the Site, and our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100).
Indemnity
You agree to indemnify Nevamiss against claims arising from your misuse of the Site or violation of these Terms.
SMS Terms
Loaderz LLC sends text messages under the Nevamiss brand only to people who opt in, for example by checking the optional SMS box on our website form. Messages are about your request: follow-up questions, scheduling, reminders and replies. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help, or call +1 (754) 219-1985. Consent to receive texts is not a condition of purchase. Mobile carriers are not liable for delayed or undelivered messages. Full details are in our SMS Terms and Privacy Policy.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules, except where the law of your place of residence requires otherwise.
Changes
We may update these Terms by posting a new version with a new "Last updated" date. Continued use of the Site means you accept the updated Terms.
